Terms of Service

Last Updated: 09292026

These Terms of Service (“Terms”) govern your access to and use of the website operated by LumaCoast, LLC(“LumaCoast,” “we,” “us,” or “our”), including our website, online store, content, products, customer support services, and other services made available through the website (collectively, the “Services”).

These Terms also apply to purchases of LumaV products made directly through LumaCoast.

Please read these Terms carefully. By accessing or using the Services, creating an account, or purchasing a product from us, you agree to be bound by these Terms and acknowledge our Privacy Policy.

IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION: THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER. EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED BELOW, YOU AND LUMACOAST AGREE TO RESOLVE COVERED DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT. PLEASE REVIEW SECTION 24, “DISPUTE RESOLUTION AND ARBITRATION,” CAREFULLY.

1. Agreement to These Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree to these Terms, you should not access or use the Services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services or purchase products directly from LumaCoast.

By using the Services, you represent that you satisfy these requirements and are not prohibited from using the Services under applicable law.

3. Privacy

Our Privacy Policy describes how LumaCoast collects, uses, stores, and shares personal information in connection with the Services.

Please review the Privacy Policy carefully. By using the Services, you acknowledge our Privacy Policy.

4. Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, business practices, products, or applicable legal requirements.

When changes are made, we may post the revised Terms on our website and update the “Last Updated” date above. We may provide additional notice where required by applicable law.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.

5. Accounts

Certain portions of the Services may allow or require you to create an account.

You agree to provide accurate, complete, and current information and to update that information when necessary.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account.

Please notify LumaCoast promptly if you believe your account or credentials have been accessed or used without authorization.

We reserve the right to suspend or terminate an account where reasonably necessary to protect LumaCoast, our customers, the Services, or other parties, or where these Terms have been violated.

6. Products and Orders

Product Information

We make reasonable efforts to accurately describe and display our products, including their features, specifications, packaging, availability, pricing, and appearance.

However, product information may occasionally contain errors or become outdated. Product appearance, packaging, specifications, components, or other characteristics may also change from time to time.

We reserve the right to correct errors and update product information as appropriate.

Product Availability

All products are subject to availability.

LumaCoast reserves the right, to the extent permitted by law, to limit quantities, discontinue products, refuse or cancel orders, or otherwise limit sales.

Order Acceptance

Submitting an order does not necessarily constitute acceptance of that order by LumaCoast.

We may decline or cancel an order for legitimate reasons including product availability, pricing or description errors, suspected fraud, payment issues, quantity limitations, or other circumstances affecting our ability to fulfill the order.

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

7. Pricing, Payment, and Taxes

Unless otherwise indicated, prices displayed through the Services are stated in U.S. dollars.

You agree to pay the charges associated with your order, including applicable product prices, shipping charges, taxes, and other charges disclosed to you before completing your purchase.

By providing a payment method, you represent that you are authorized to use that payment method and authorize LumaCoast and its third-party payment processors to charge the applicable amount.

Payment information may be processed by third-party payment providers. LumaCoast may not directly receive or store all payment card information submitted during checkout.

Applicable sales tax may be calculated based on your shipping destination and other factors required by applicable law.

We reserve the right to correct pricing, billing, or payment errors.

8. Shipping

Order processing and shipping are governed by our then-current Shipping Policy.

Shipping and delivery dates are estimates unless expressly stated otherwise. Delivery may be affected by carriers, weather, product availability, holidays, or circumstances outside LumaCoast’s reasonable control.

Risk of loss and title to products will transfer as provided under applicable law and the shipping terms applicable to your purchase.

9. Returns and Refunds

Returns and refunds are governed by our Return Policy.

Because LumaV is an intimate-use product, health, hygiene, and safety restrictions may apply to products that have been opened or whose security seal has been removed, broken, or damaged.

We encourage you to review the Return Policy before opening your LumaV product if you believe you may wish to return it.

Nothing in our Return Policy limits consumer rights that cannot lawfully be waived or restricted.

10. LumaV Limited Warranty

Eligible LumaV products are subject to the LumaV Limited Warranty provided by LumaCoast.

The Limited Warranty describes applicable warranty eligibility requirements, coverage, exclusions, duration, remedies, and procedures for submitting a warranty claim.

The Limited Warranty is incorporated into these Terms by reference where applicable.

Nothing in the Limited Warranty or these Terms limits consumer rights that cannot lawfully be waived or restricted.

11. Health and Medical Disclaimer

THE INFORMATION AVAILABLE THROUGH THE SERVICES IS NOT INTENDED TO CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT AND SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.

Always seek the advice of an appropriately qualified healthcare professional regarding questions concerning your health, medical conditions, symptoms, treatment, or whether a particular product is appropriate for you.

Do not disregard professional medical advice or delay seeking medical care because of information obtained through the Services.

If you believe you are experiencing a medical emergency, seek appropriate emergency medical assistance.

LumaCoast does not guarantee that use of LumaV will produce any particular health, wellness, physical, therapeutic, or other result. Individual experiences may vary.

12. Proper Use of LumaV

You are responsible for reviewing and following all instructions, warnings, contraindications, safety information, and other materials provided with your LumaV product.

LumaV should be used only for its intended purpose and in accordance with the applicable instructions for use.

Information appearing on the LumaCoast website does not supersede safety instructions, warnings, contraindications, or directions accompanying the product.

If you have questions regarding whether LumaV is appropriate for you, consult an appropriately qualified healthcare professional.

13. Intellectual Property

The Services and their content, including text, graphics, photographs, videos, designs, logos, trademarks, trade names, product names, software, website design, and other materials, are owned by or licensed to LumaCoast and are protected by applicable intellectual property laws.

Subject to these Terms, LumaCoast grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for your personal, non-commercial purposes.

Except as expressly permitted by LumaCoast or applicable law, you may not copy, reproduce, modify, distribute, sell, license, publish, publicly display, create derivative works from, or commercially exploit content obtained through the Services.

Nothing in these Terms transfers ownership of any LumaCoast intellectual property to you.

14. Feedback

If you voluntarily provide comments, ideas, suggestions, proposals, or other feedback concerning LumaCoast, LumaV, or the Services (“Feedback”), you grant LumaCoast the right to use that Feedback without restriction or compensation to you, subject to applicable law.

Please do not submit confidential or proprietary information as Feedback unless LumaCoast has separately agreed in writing to receive it on a confidential basis.

15. Acceptable Use

You agree not to misuse the Services.

You may not:

  • Violate applicable law through your use of the Services;
  • Attempt to gain unauthorized access to accounts, computer systems, servers, networks, or non-public areas of the Services;
  • Probe, scan, or test the vulnerability of the Services without authorization;
  • Interfere with or disrupt the operation, integrity, performance, or security of the Services;
  • Introduce viruses, malware, malicious code, or other harmful technology;
  • Circumvent technological or security measures used to protect the Services;
  • Use automated systems, bots, crawlers, scraping tools, or similar technologies to extract content or data except as permitted by applicable law or expressly authorized by LumaCoast;
  • Impersonate another person or entity or misrepresent your identity or affiliation;
  • Use the Services to engage in fraudulent, deceptive, threatening, abusive, or unlawful conduct;
  • Infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other legal rights of another person; or
  • Encourage, assist, or enable another person to engage in any of the foregoing.

LumaCoast may investigate suspected violations and take reasonable steps to protect the Services, our business, customers, and other parties.

16. Third-Party Services and Links

The Services may contain links to or integrations with websites, payment processors, platforms, social networks, services, or resources operated by third parties.

These resources may be provided for convenience and are not controlled by LumaCoast.

Your use of third-party services may be governed by separate terms and privacy policies. To the maximum extent permitted by law, LumaCoast is not responsible for third-party content, products, services, practices, security, or availability.

LumaCoast respects the intellectual property rights of others.

Your notice should contain sufficient information to identify the protected work, identify and locate the allegedly infringing material, allow us to contact you, and evaluate your claim.

If LumaCoast designates an agent under the Digital Millennium Copyright Act, the appropriate agent information and notice requirements will be provided here.

18. Termination

LumaCoast may suspend or terminate access to the Services or an account where reasonably necessary, including for violations of these Terms, suspected fraudulent or unlawful conduct, security concerns, or conduct that could harm LumaCoast, our customers, or others.

You may discontinue your use of the Services at any time.

Provisions that by their nature should survive termination—including provisions relating to intellectual property, disclaimers, indemnification, limitations of liability, governing law, and dispute resolution—will survive termination.

19. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

LUMACOAST DISCLAIMS WARRANTIES CONCERNING THE OPERATION OR AVAILABILITY OF THE WEBSITE AND SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

LUMACOAST DOES NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT INFORMATION AVAILABLE THROUGH THE SERVICES WILL ALWAYS BE COMPLETE, ACCURATE, OR CURRENT.

THIS SECTION RELATES TO THE WEBSITE AND SERVICES. WARRANTY COVERAGE APPLICABLE TO ELIGIBLE PHYSICAL LUMAV PRODUCTS IS ADDRESSED SEPARATELY IN THE LUMAV LIMITED WARRANTY.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

20. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless LumaCoast, LLC and its affiliates, members, managers, officers, employees, agents, representatives, and service providers from and against claims, demands, liabilities, damages, losses, judgments, and reasonable costs and expenses, including reasonable attorneys’ fees, arising out of or relating to:

(a) your misuse of the Services;
(b) your violation of these Terms;
(c) your violation of applicable law; or
(d) your infringement or violation of another person’s rights.

Your obligations under this section are subject to any restrictions imposed by applicable law.

21. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMACOAST, LLC AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE SERVICES.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR THE COST OF SUBSTITUTE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMACOAST’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO LUMACOAST FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

THE FOREGOING EXCLUSIONS AND LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Some jurisdictions do not permit certain exclusions or limitations of liability. Accordingly, some portions of this section may not apply to you.

22. Governing Law

These Terms and any dispute arising out of or relating to these Terms, the Services, or your relationship with LumaCoast will be governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, together with applicable federal law.

The Federal Arbitration Act will govern the interpretation and enforcement of the arbitration provisions contained in Section 24.

For disputes that are not required to be resolved through arbitration, and except where applicable law provides otherwise, you and LumaCoast consent to the exclusive jurisdiction and venue of the applicable state courts located in St. Johns County, Florida, or the applicable federal court having jurisdiction over St. Johns County, Florida.

23. Informal Dispute Resolution

Before commencing arbitration or other formal legal proceedings, you and LumaCoast agree to make a reasonable good-faith effort to resolve the dispute informally.

The party asserting a dispute should provide the other party with written notice describing the nature and basis of the dispute and the relief requested.

Notices to LumaCoast should be sent to:

LumaCoast, LLC
Attn: Legal
13241 Bartram Park Blvd, Unit 713
Jacksonville, FL 32258
United States

Email: support@luma-coast.com

The parties will have thirty (30) days following receipt of the notice to attempt to resolve the dispute informally before either party initiates arbitration, unless applicable law requires otherwise.

24. Dispute Resolution and Arbitration

A. Agreement to Binding Individual Arbitration

Except for the limited exceptions described below, you and LumaCoast agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, a LumaV product, your purchase or use of a LumaV product, the LumaV Limited Warranty, or your relationship with LumaCoast will be resolved through binding individual arbitration rather than in court.

This arbitration agreement applies regardless of the legal theory on which a claim is based, including claims arising under contract, warranty, statute, regulation, tort, fraud, misrepresentation, or other legal theory, to the extent such claims may lawfully be subject to arbitration.

BY AGREEING TO ARBITRATION, YOU AND LUMACOAST UNDERSTAND THAT EACH IS WAIVING THE RIGHT TO HAVE COVERED DISPUTES DECIDED BY A JUDGE OR JURY IN COURT.

B. Arbitration Administrator and Rules

Arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with its applicable Consumer Arbitration Rules and Mediation Procedures then in effect, as modified by these Terms and as permitted by applicable law.

Information regarding AAA rules, procedures, forms, and applicable fees is available from the American Arbitration Association.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.

C. Initiating Arbitration

A party seeking arbitration must provide the other party with the notice required under Section 23 and, if the dispute remains unresolved after the informal-resolution period, submit the applicable Demand for Arbitration and other materials required by AAA.

The arbitration will be conducted by a neutral arbitrator selected in accordance with the applicable AAA rules.

D. Location and Manner of Arbitration

The arbitration may be conducted through documents, telephone, videoconference, or an in-person hearing as provided under the applicable AAA Consumer Arbitration Rules and applicable law.

Any in-person hearing will take place at a location determined in accordance with the applicable AAA Consumer Arbitration Rules unless you and LumaCoast agree otherwise.

E. Arbitration Fees

Payment of filing, administration, and arbitrator fees will be governed by the applicable AAA Consumer Arbitration Rules and fee schedule, except where applicable law requires otherwise.

Each party will bear its own attorneys’ fees and costs unless the arbitrator awards such fees or costs where authorized by applicable law, the AAA rules, or another applicable agreement.

F. Authority of the Arbitrator

Subject to applicable law, the arbitrator may award the same individual remedies and relief that would otherwise be available in court for the claims presented, including monetary, declaratory, or injunctive relief where authorized.

Any arbitration award will be final and binding, subject to the limited review available under applicable arbitration law.

Judgment on an arbitration award may be entered in any court having jurisdiction.

G. Exceptions to Arbitration

Notwithstanding the foregoing:

  1. Either you or LumaCoast may bring an individual claim in small claims court if the claim qualifies and remains within that court’s jurisdiction; and
  2. Either party may seek appropriate injunctive or equitable relief from a court of competent jurisdiction to prevent or address actual or threatened infringement or misappropriation of intellectual property rights.

Nothing in these Terms requires arbitration of a claim that applicable law prohibits from being subject to mandatory arbitration.

H. Class Action and Representative Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND LUMACOAST AGREE THAT EACH MAY BRING COVERED CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION OR PROCEEDING.

Unless you and LumaCoast expressly agree otherwise, the arbitrator may not consolidate the claims of more than one person and may not preside over a class, collective, consolidated, mass, or representative proceeding except to the extent applicable law requires otherwise.

I. Severability

If any portion of this arbitration agreement is determined to be invalid or unenforceable, that provision will be severed or limited to the minimum extent necessary, and the remaining provisions will continue in effect, except where applicable law requires a different result.

If the Class Action and Representative Action Waiver is determined to be unenforceable with respect to a particular claim or request for relief and that determination requires the claim to proceed on a class or representative basis, that claim or request for relief will proceed in a court of competent jurisdiction rather than in arbitration, while any enforceable individual claims will remain subject to arbitration to the extent permitted by law.

25. General Terms

Entire Agreement

These Terms, together with policies and terms expressly incorporated into them, constitute the agreement between you and LumaCoast concerning the Services and supersede prior understandings concerning the same subject matter.

Assignment

You may not assign or transfer your rights or obligations under these Terms without LumaCoast’s prior written consent.

LumaCoast may assign or transfer its rights and obligations in connection with a merger, acquisition, reorganization, sale of assets, financing, corporate restructuring, or similar transaction, or as otherwise permitted by law.

Severability

Except as specifically provided in the arbitration provisions above, if a provision of these Terms is determined to be invalid or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.

Waiver

LumaCoast’s failure to enforce a provision of these Terms does not constitute a waiver of that provision or LumaCoast’s right to enforce it subsequently.

Force Majeure

To the extent permitted by applicable law, LumaCoast will not be responsible for delays or failures caused by circumstances reasonably beyond its control, including severe weather, natural disasters, fire, flood, war, civil disturbance, governmental actions, transportation disruptions, labor disputes, supply shortages, telecommunications failures, or similar events.

Headings

Section headings are provided for convenience and do not affect the interpretation of these Terms.
