LumaCoast, LLC (“LumaCoast,” “we,” “our,” or “us”) provides this limited warranty for the LumaV device against qualifying defects in materials and workmanship arising under normal and intended use.
Subject to the terms, conditions, and exclusions below, this limited warranty lasts for one (1) year from the original date of purchase, provided the LumaV device is registered within ninety (90) days of purchase.
What Is Covered by This Limited Warranty?
This limited warranty covers qualifying defects in materials and workmanship affecting the LumaV device and hardware accessories originally supplied with the device.
Coverage is provided exclusively to the original purchaser and may not be transferred or assigned to another person.
To qualify for warranty coverage, the LumaV device must have been purchased directly from LumaCoast or from a retailer, distributor, or dealer authorized by LumaCoast.
If LumaCoast determines that a LumaV device contains a defect covered by this limited warranty, LumaCoast will provide the remedy described below, subject to applicable law.
What Is Not Covered by This Limited Warranty?
LumaCoast does not warrant or guarantee any particular result, experience, benefit, therapeutic effect, or other outcome resulting from use of the LumaV device. Individual experiences and results may vary.
This limited warranty does not apply to:
- Products purchased by anyone other than the original purchaser;
- Products purchased from an unauthorized retailer, reseller, distributor, dealer, marketplace, or other unauthorized source;
- Products manufactured by third parties;
- Normal wear and tear;
- Cosmetic deterioration that does not affect normal operation of the device;
- Damage resulting from accident, impact, abuse, or misuse;
- Improper use, cleaning, maintenance, care, or storage;
- Failure to follow product instructions, warnings, contraindications, or recommended-use guidelines;
- Unauthorized modification, alteration, disassembly, maintenance, or repair;
- Introduction or insertion of foreign objects;
- Use with unauthorized or incompatible accessories, equipment, components, or products;
- Exposure to harmful chemicals, inappropriate cleaning products, or abrasive materials;
- Negligence or improper handling;
- Loss, theft, or vandalism;
- Fire, flooding, water damage, natural disasters, or other external events;
- Use outside the product’s intended purpose or recommended operating conditions; or
- Damage resulting from excessive, unintended, or improper use.
This warranty does not cover a product solely because the purchaser is dissatisfied with the results experienced through use of LumaV.
How Long Does This Limited Warranty Last?
The warranty period begins on the original date of purchase and expires one (1) year later.
The LumaV device must be registered within ninety (90) days of the original purchase date to qualify for this limited warranty.
LumaCoast may require proof of purchase, registration information, product serial numbers, or other reasonable documentation when evaluating a warranty claim.
How Do I Submit a Warranty Claim?
If you believe your LumaV device has a defect in materials or workmanship covered by this warranty, contact LumaCoast Customer Care before the applicable warranty period expires.
When submitting a warranty request, please be prepared to provide information that may include:
- Your name and contact information;
- Proof and date of purchase;
- Place of purchase;
- Product serial number or other identifying information;
- A description of the problem;
- Photographs or video demonstrating the issue, if requested; and
- Other information reasonably necessary to evaluate the claim.
LumaCoast may request that the affected product be returned for inspection before determining whether the claim qualifies for warranty coverage.
What Will LumaCoast Do?
If LumaCoast confirms that your LumaV device has a defect covered by this limited warranty, LumaCoast will, at its discretion and subject to applicable law, replace the defective device with a new or replacement device that is the same as or reasonably comparable to the product originally purchased.
Unless otherwise required by applicable law, replacement of the qualifying defective product is the exclusive remedy provided under this limited warranty.
Warranty Limitations and Disclaimers
THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE OR FROM ONE JURISDICTION TO ANOTHER.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMACOAST’S RESPONSIBILITY FOR MALFUNCTIONS OR DEFECTS IN PRODUCTS COVERED BY THIS LIMITED WARRANTY, AND YOUR REMEDIES FOR BREACH OF THIS LIMITED WARRANTY, ARE LIMITED TO THE REMEDIES EXPRESSLY PROVIDED HEREIN.
THE EXPRESS LIMITED WARRANTY SET FORTH HEREIN IS PROVIDED IN PLACE OF ALL OTHER EXPRESS WARRANTIES, EXCEPT TO THE EXTENT OTHERWISE REQUIRED BY APPLICABLE LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMACOAST DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IF APPLICABLE LAW DOES NOT PERMIT THE DISCLAIMER OF AN IMPLIED WARRANTY, THE DURATION OF ANY SUCH IMPLIED WARRANTY WILL BE LIMITED TO THE DURATION OF THIS EXPRESS LIMITED WARRANTY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUMACOAST, LLC AND ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, DISTRIBUTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE LUMAV DEVICE, ITS USE, INABILITY TO USE IT, OR A BREACH OF THIS LIMITED WARRANTY, WHETHER BASED ON WARRANTY, CONTRACT, NEGLIGENCE, STRICT PRODUCT LIABILITY, TORT, OR ANY OTHER LEGAL THEORY.
THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
SOME STATES OR JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.
Nothing in this limited warranty is intended to exclude, restrict, or modify consumer rights or remedies that cannot lawfully be excluded, restricted, or modified.
Product Changes and Improvements
LumaCoast reserves the right to modify, update, discontinue, redesign, or improve its products, packaging, components, specifications, features, or accessories without incurring an obligation to incorporate those modifications or improvements into products previously manufactured or sold.
Nothing in this section limits obligations imposed on LumaCoast by applicable law.
Warranty Claims
Requests for warranty service must be submitted during the applicable one-year limited warranty period.
Submitting a warranty claim does not automatically establish that a product is defective or eligible for replacement. LumaCoast reserves the right to reasonably evaluate the product and circumstances surrounding the claim before determining warranty eligibility.
Governing Law
This limited warranty will be governed by the laws of the State of Florida, without regard to its conflict-of-laws principles, together with applicable federal law.
Nothing in this section limits rights or protections available to consumers under applicable law that cannot lawfully be waived or restricted.
Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to this Limited Warranty, a LumaV product, the purchase or use of a LumaV product, or warranty services provided by LumaCoast is subject to the applicable Dispute Resolution and Arbitration provisions contained in the LumaCoast Terms of Service, which are incorporated into this Limited Warranty by reference to the extent permitted by applicable law.
Those provisions include, subject to their terms and applicable law, binding individual arbitration administered by the American Arbitration Association (“AAA”) and a class action and representative action waiver.
Please review the LumaCoast Terms of Service carefully before purchasing or using a LumaV product.
For disputes that are not required to be arbitrated under the Terms of Service, and except where applicable law provides otherwise, the applicable court venue will be the state courts located in St. Johns County, Florida, or the applicable federal court having jurisdiction over St. Johns County, Florida.
No Other Warranties
Unless expressly modified in a written agreement authorized by LumaCoast, this Limited Warranty constitutes LumaCoast’s complete express limited warranty regarding the LumaV products covered by it.
No employee, retailer, distributor, dealer, reseller, representative, agent, or other third party is authorized to create, modify, expand, or extend this Limited Warranty on behalf of LumaCoast unless expressly authorized to do so in writing by LumaCoast.
Statements made by unauthorized third parties do not modify this Limited Warranty.
Force Majeure
To the extent permitted by applicable law, LumaCoast will not be responsible for a delay or inability to perform its obligations under this Limited Warranty resulting from circumstances reasonably beyond its control.
Such circumstances may include severe weather, natural disasters, fire, flooding, war or civil disturbance, governmental action, changes in law or regulation, labor disputes, transportation interruptions, shortages of materials or components, telecommunications or infrastructure failures, or other events outside LumaCoast’s reasonable control.
Severability
If any provision of this Limited Warranty is determined by a court or other authority of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or, where necessary, severed.
The remaining provisions will continue in effect.
Waiver
LumaCoast’s failure to enforce a provision of this Limited Warranty on one occasion does not constitute a waiver of that provision or LumaCoast’s right to enforce it in the future.
A waiver of one provision does not constitute a waiver of another provision.
Miscellaneous Terms
For purposes of this Limited Warranty:
“LumaCoast,” “we,” “our,” and “us” mean LumaCoast, LLC and, where applicable, its authorized successors and assigns.
“You” and “your” mean the original purchaser of the LumaV device.
“LumaV,” “LumaV device,” “device,” and “product” refer to the LumaV product covered by this Limited Warranty, as applicable.
Headings are provided for convenience and do not alter the interpretation of this Limited Warranty.
This Limited Warranty is subject to applicable federal, state, and local laws. Where a provision conflicts with a consumer right that cannot legally be waived or restricted, applicable law will control.
